The collection, processing, and subsequent use of personal data comply with Colombia’s current data protection legislation, established by Law 1581 of 2012, known as the Personal Data Protection Law (hereinafter LPDP), and its complementary regulations. NBO S.A.S. is solely responsible for and guarantees the confidentiality and security of personal data collected through the website and accepts no responsibility for data processing and subsequent use by third-party information society service providers operating outside the website.

WHEN IS PERSONAL DATA COLLECTED ON THE WEBSITE?

NBO S.A.S. informs users and clients that the collection of personal data may occur mainly through emails sent to the address info@nbo.com.co, whenever the email includes personal data, as well as through any forms that NBO S.A.S. may add to the website in the future and in which NBO S.A.S. is identified as the data controller.

NBO S.A.S. will inform website users whether filling in all requested data is optional or mandatory.

If you do not wish NBO S.A.S. to process your personal data, please refrain from filling in the forms available on the website. In any case, NBO S.A.S. will expressly and legibly inform you of the conditions under which personal data is collected, its intended uses, whether the data must be provided, the rights of users, the conditions for exercising those rights, and any other complementary information.

Processing personal data includes automated or non-automated operations and technical procedures that allow data collection, recording, preservation, processing, modification, blocking, and cancellation, as well as data transfers resulting from communications, consultations, interconnections, and transfers.

PURPOSE OF PERSONAL DATA COLLECTION AND PROCESSING

For personal data collected through email and/or website forms, the purposes of processing include responding to your message, addressing your information request, adding you or your company to our contact list, facilitating future business relationships or managing an existing business relationship, conducting necessary communications through you, sending required documentation or requested information, and maintaining a history of business relationships and communications.

DATA PROVIDED TO NBO S.A.S. MUST BE ACCURATE AND UP-TO-DATE

If the user is a minor or legally incapacitated, NBO S.A.S. requires consent from parents, guardians, or legal representatives before submitting personal data. NBO S.A.S. informs users of their rights under the LPDP. At any time, users may know which data has been collected and processed by NBO S.A.S. about them; correct inaccurate information; cancel this data or object to its processing—limited to cases where consent is not required for data processing, provided no other law specifies otherwise, and when there are justified, legitimate reasons related to a specific personal situation or when data is processed for advertising and commercial prospecting.

Users must submit a written request to exercise these rights, including a copy of their National Identification Document or another valid form of identification, to NBO S.A.S. at Carrera 86 No. 37 B – 26, Medellín, or any new address registered with the General Data Protection Registry. The request should include the following information:

User’s full name.
Detailed request.
Address for notifications, date, and user signature.
Supporting documents for the request, if applicable.
NBO S.A.S. informs users that these rights are personal, meaning only the user can exercise these rights concerning their personal data. In exceptional cases, an authorized representative may exercise the user’s rights, provided that the communication includes proof of such representation.

NBO S.A.S. warns that exercising these rights by a third party without the user’s legal authorization may constitute a violation of confidentiality laws, punishable by imprisonment under the Criminal Code, without prejudice to other civil or administrative actions available to both the rightful data owner and NBO S.A.S.

RECOMMENDATIONS FOR USERS

NBO S.A.S. recommends users use the latest versions of software, which offer improved security measures.

Likewise, NBO S.A.S. recommends users utilize security mechanisms at their disposal (secure web servers, cryptography, digital signatures, firewalls, etc.) to protect data confidentiality and integrity, as impersonation or communication breaches pose risks.

NBO S.A.S. reminds users that the internet is not always as secure as desired, so they should adopt the necessary and appropriate technical measures to prevent unauthorized data processing.

NBO S.A.S. advises users to remember that any personal information provided online through email, newsgroups, discussion forums, etc., can be collected and used for undesired purposes. Therefore, users are encouraged to familiarize themselves with the confidentiality and privacy policies of online sites they visit.

NBO S.A.S. also reminds users that, unless they use encryption mechanisms, email on the internet is not secure. Email messages and discussion forums can be falsified and impersonated, so users should be mindful of this when using these tools. If they do not want their email address published, they should configure their browser to prevent their email address from being left on the web servers they access.
